Flyway

Terms of Service

Effective October 8, 2026.

These Terms of Service (“Terms”) are an agreement between you and Warp Drive Enterprises LLC, a Utah limited liability company (“we,” “us”), 2637 N Washington Blvd Ste 257, North Ogden, UT 84414, USA (tryflywayapp@gmail.com). They govern your use of the Flyway website and web app at www.tryflyway.com and the Flyway apps for iPhone and Android (the “Service”). By using the Service you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service.

1. What Flyway is (and isn’t)

Flyway is a community map of publicly visible automatic license-plate reader (ALPR) cameras, with drive-time warnings and optional camera-avoid routing. Flyway does not disable, block, or interfere with cameras, hide or alter license plates, or advise you to break any law. Map data comes from OpenStreetMap contributors (via DeFlock) and from Flyway users.

2. Eligibility and accounts

3. Driving safety — read this

4. Map accuracy

Camera locations, types, facing directions, and statuses are crowdsourced and may be wrong, out of date, or missing. A camera may exist where none is shown, and pins may be misplaced or tag ordinary cameras. Moving a pin, marking it damaged, or marking it gone takes several independent reports (currently five accounts in 48 hours). Do not rely on Flyway to avoid being recorded, or for any legal, safety, or law-enforcement purpose. Travel times and traffic data from third parties may be inaccurate.

5. Acceptable use

You agree to use the Service lawfully and not to:

We may remove content, hide reports, limit features, or suspend or terminate accounts that violate these Terms.

6. Your content

You keep ownership of the reports, notes, and other content you submit (“User Content”). You grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable license to host, store, display, reproduce, modify (for example merge duplicates or average locations), and distribute your User Content as part of the community map and to operate and improve the Service. Camera pins remain on the map as anonymous community data after you delete your account. You represent that your User Content is accurate to the best of your knowledge and doesn’t violate anyone’s rights or any law. Reports are public; your name is not shown with them.

To report an abusive, offensive, or inaccurate note, tap the pin and use Report under the note. For a wrong pin, use “Not here” and the other report options. You can also email tryflywayapp@gmail.com. Notes reported by several users are hidden while we review them, and we may remove content or accounts that break these Terms.

7. Flyway Plus subscriptions

8. Affiliate program

Signed-in users may share a personal invite link and earn a commission (currently 10%) on Plus payments made by people who first arrive through that link and later subscribe (“first link wins”). No self-referrals. Commissions are held about 14 days for refunds and chargebacks, can be requested once the available balance is at least $10, and are paid to the payout email you provide. You’re responsible for any taxes on your earnings and may be asked for tax information (such as Form W-9) before payout. We may withhold or reverse commissions for fraud, spam, self-dealing, chargebacks, or Terms violations, and may change or end the program at any time. Unpaid commissions are forfeited if you delete your account. Affiliates are independent; this isn’t employment, agency, or partnership.

9. Third-party services and data

The Service relies on third parties such as Google, Stripe, TomTom, OpenStreetMap, OpenFreeMap, and, as fallbacks, OSRM, Nominatim, and Photon. Their services are governed by their own terms, and we’re not responsible for them. Map data © OpenStreetMap contributors, available under the Open Database License. Apple and Google are not parties to these Terms and have no obligation to support the app. If you got the app from the App Store, Apple’s Licensed Application End User License Agreement also applies to your use of the iOS app, and Apple is a third-party beneficiary of these Terms for that purpose.

10. Our intellectual property

The Service, including its software, design, logos, and the “Flyway” name, belongs to us or our licensors. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use under these Terms.

11. Disclaimer of warranties

The Service and all map, routing, traffic, and camera data are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement, and any warranty that the Service will be uninterrupted, error-free, or that any camera will be shown or avoided. We make no warranty regarding navigation, routes, or driving safety.

12. Limitation of liability

To the fullest extent permitted by law, Warp Drive Enterprises LLC and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill, or for any traffic citations, fines, accidents, injuries, property damage, or legal consequences arising from your use of (or inability to use) the Service, missing or inaccurate pins, routing choices, or your driving. Our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim or (b) $50 USD. Some jurisdictions don’t allow certain limitations, so some of these may not apply to you.

13. Indemnity

You agree to defend, indemnify, and hold us harmless from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your User Content, your misuse of the Service, your driving, or your violation of these Terms or any law or third-party right.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or end your access at any time for violations of these Terms or to protect the Service or others. Sections that by their nature should survive (including 6, 8 for accrued obligations, and 11 through 16) survive termination.

15. Governing law and disputes

These Terms are governed by the laws of the State of Utah and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Weber County, Utah, and you and we consent to their jurisdiction, except that either party may bring an individual claim in small-claims court.

16. Changes and other terms

We may update these Terms. We’ll change the effective date and, for material changes, notify you in the app or by email; continuing to use the Service after changes take effect means you accept them. These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision isn’t a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
